Gunman Gets 22 Years for Firing into Crowd Killing Construction Worker in Bronx

BRONX - A convicted gunman will spend the next 22 years in prison for killing a man when he opened fire into a crowd. The victim was sitting in his car when the bullet struck him. 





Bronx District Attorney Darcel Clark said the defendant, Lamel Evans, 23, of Rochambeau Avenue, was sentenced by Bronx Supreme Court Justice Laurence Busching to 22 years in prison and 5 years of post-release supervision for first-degree Manslaughter, and 2-10 years in prison and 5 years of post-release supervision for second-degree Criminal Possession of a Weapon, to run concurrently. 





The defendant was found guilty of the charges on February 16, 2023, after a jury trial.

According to the investigation, on September 5, 2018, at approximately 3:14 a.m., in front of 1515 Selwyn Avenue, the defendant fired a gun from a distance into the direction of a group of people. The bullet struck Jaquan Smith, a 21-year-old construction worker, in the eye while he was sitting in a nearby vehicle. A friend of the victim drove Smith to Bronx-Lebanon Hospital where he died from his injuries.





“The defendant fired a gun into a crowd of people, striking a 21-year-old man, and causing his death,” Clark said. “The defendant was convicted by a jury of Manslaughter and was sentenced to 22 years in prison. Our priority is to get guns off our streets, while holding people who act with complete disregard to human life accountable.”




 

After the incident, the defendant took a cab, which was pulled over for an unrelated offense at approximately 4:10 a.m. near 2074 Webster Avenue. 


Police searched Evans after identifying the smell of an illegal substance and found a loaded magazine and a gun, which was then connected to Smith’s death. When questioned about the weapon, the defendant told officers he was testing the gun.
